This page specifies the conditions of use to which the user must subscribe in order to be able to use this Internet website.

By using this site, the user acknowledges having read, understood and accepted the terms and conditions hereinafter mentioned. This page may be subject to change without notice (These changes will come into effect forthwith).

It is the responsibility of the user to consult regularly this page in order to know the usages accepted on this site.

2. Definitions

Non-public properties

Section 2 of the National Defense Act (NDA) defines non-public properties as:

 

  1. (a) all money and property, other than issues of materiel, received for or administered by or through messes, institutes or canteens of the Canadian Forces,
  2. (b) all money and property contributed to or by officers, non-commissioned members, units or other elements of the Canadian Forces for the collective benefit and welfare of those officers, non-commissioned members, units or other elements,
  3. (c) by-products and refuse and the proceeds of the sale thereof to the extent prescribed under subsection 39(2), and
  4. (d) all money and property derived from, purchased out of the proceeds of the sale of, or received in exchange for, money and property described in paragraphs (a) to (c); 


Silent Auction

A silent auction is an auction where the offer made by potential buyers is kept secret.

3. About EncanFNP.ca

EncanFNP.ca is a website designed to report surplus inventory of non-public properties belonging to the Second Division of Canada for possible auctioning.

You will find on this website the list of the non-public goods (BNP) put on sale. This sale will take place through a silent auction.


4. Terms and conditions

On the day said, the bets are opened and the item for sale goes to the highest bidder. However, it is important to understand that no bets will be accepted outside the FNP.ca auction website, whether by paper or email. Items / Auctions have a specific start and end (date and time). Any offer transmitted outside these ranges will be deemed invalid.

In case of a tie, buyers will be contacted and will have a chance to increase their offer.

 

5. User account

To access the EncanFNP.ca site, a user account must first be created.

To do this, the user will have to register his e-mail and create a password which must remain strictly confidential.

The user will be responsible in case of misuse of his password or his username. He will also be responsible for any transactions made using his username and password. In case of doubt about the use of his account by a third party, it is the responsibility of the user to notify EncanFNP.ca without delay.

ENCANFNP.CA RESERVES THE RIGHT TO REFUSE OR WITHDRAW ACCESS TO A USER WITHOUT NOTICE AND WITHOUT JUSTIFICATION. 

AFTER THE DELETION OF ITS ACCOUNT, THE USER REMAINS COMMITTED RELATIVELY TO ALL OFFERS ALREADY ENROLLED ON ENCANFNP.CA BEFORE THE DELETION OF THE ACCOUNT.

Users will have access at all times to ‘’MY ACCOUNT’’ area to make changes to their account or to update their personal information. It is the responsibility of the user to keep his / her information up to date.

 

6. Commitment

No credit card is required to bet on an item. However, the user agrees to come collect and proceed to the full payment in the 5 days after the auction’s results have been shown..

If he fails to pay and / or recover his property, the user will be denied access to his account. Any commitment not respected may result in the deletion of the user's account.

In the event that a winner does not show up within 5 days or fails to return his calls, the property will go to the 2nd highest bidder without notice.

 

7. Payment and transport

Once the winner has been contacted, it is his responsibility to come and pay for and recover his property on the date agreed upon with the seller. The recovery of the property must be done at the same time as the payment.

THE USER MUST ALSO MAKE SURE TO BE ABLE TO TRANSPORT HIS PROPERTY. NO TRANSPORT SHALL BE PROVIDED BY THE SELLER

 

8. Warranty

By participating in the silent auction, the user adheres to the following principles:

  • All sales are final;
  • No exchange or refund will be accepted;
  • All items are sold "as is".

No warranty covers items sold. This is why it is strongly suggested to users to come and see the items to be sold during the visiting hours before betting. EncanFNP.ca is not responsible for any item breakage or damage to the user's vehicle / trailer during transportation.

 

9. Promotion

By subscribing to this site, you consent to EncanFNP.ca to send you emails about sales, events and upcoming events.

If you no longer wish to receive these messages, please notify us via the contact page of this site.

 

10. Common language

Any individual who publishes or sends a hateful, homophobic, racist or any other defamatory comment on EncanFNP.ca will have their account immediately suspended without notice. There will be no tolerance for vulgar language, no matter what are the circumstances.
